Terms of Use

Version 0.1 (pre-launch draft) · Last updated: 19 October 2026

This is a pre-launch draft. Captson isn’t open yet, and these terms will be reviewed by a lawyer and completed before launch. Parts marked “Set before launch” aren’t in force yet.

These terms are the agreement between you and Captson for using captson.com and the Captson app (together, “Captson”). By using Captson, or by clicking “I agree” or a similar button, you accept them for yourself or for the business you represent, and confirm you have the authority to do so. If you don’t agree, please don’t use Captson.

Each section starts with a line in plain words. The plain line helps you read; the full text is what applies. Our Privacy notice explains how we handle your data.

1. Who can use Captson

In plain words: You need to be 18 or over, and the information you give us must be true.

You must be at least 18 years old to use Captson. If you use it for a business or for clients, you confirm you’re allowed to act for them.

2. Your account

In plain words: You sign in with Google. Keep your Google account safe, and tell us if something looks wrong.

Sign-in is with a Google account. At launch, only Gmail addresses (ending in @gmail.com) can create an account. You’re responsible for activity under your account and for keeping your Google account secure. If you think someone else has accessed your Captson account, tell us straight away.

You can delete your account at any time from your settings. We may suspend or close accounts as described in section 11.

3. What Captson does

In plain words: Captson writes and reviews social media content. We may improve or change features over time.

Captson writes captions, titles, hooks and scripts, reviews content, suggests post ideas, audits profiles and, on some plans, tracks where posts appear in search and in AI answers. Features and limits depend on your plan, as shown on the pricing page.

We may add, change, pause or remove features. If a change takes away something important from a paid plan you’re on, we’ll tell you in advance and you can cancel.

4. No ranking guarantees

In plain words: We help posts be found. We never promise a position, views, followers or citations.

Search engines, AI answer engines and social platforms decide what they show and in what order, and they change how they do it. Captson can’t control that. We don’t guarantee any ranking, position, view count, follower number, AI citation, sale or other result. Scores and verdicts are readiness assessments based on our checklist, not predictions of results.

5. AI-written content can be wrong

In plain words: Captson uses AI. Check everything before you post: you decide what goes out under your name.

Captson uses artificial intelligence to write and review content. AI output can be inaccurate, incomplete or unsuitable, and similar requests from different people may get similar results. Review and edit everything before you post it. You’re responsible for what you publish, including making sure it’s accurate, lawful and follows each platform’s rules and advertising disclosure requirements.

6. Your content stays yours

In plain words: You own what you upload and what Captson writes for you. We use it only to provide Captson.

“Your content” means what you upload or connect (posts, captions, videos, images, profile details) and what Captson produces for you. As between you and us, you own your content. You give us a limited licence to store, process and display it only to provide Captson to you, including sending it to the service providers listed in our Privacy notice.

We never sell your content and never use it to train AI models. When you delete content, disconnect an account or delete your Captson account, the related data is deleted as set out in the Privacy notice.

You confirm you have the right to use the content you give us, including any people, music or brands in it.

7. Fair use

In plain words: Use Captson to get real posts found by real people. No spam, no fake engagement, nothing illegal.

You agree not to use Captson to:

  • create spam, keyword stuffing, misleading clickbait or content meant to deceive people or search engines;
  • run or support fake engagement, engagement pods, bought followers, follow/unfollow schemes or comment spam;
  • create unlawful, hateful, harassing or sexually explicit content, or content that infringes someone else’s rights;
  • break the terms of Instagram, TikTok, YouTube, LinkedIn, Google or any other platform you use with Captson;
  • get around plan limits, share an account outside your plan, or resell Captson without our written agreement;
  • copy, scrape, reverse-engineer or overload Captson, or use it to build a competing product;
  • use Captson for anything other than social media and search content (it isn’t a general AI assistant).

8. Other platforms

In plain words: If you connect Instagram or other services, their rules apply too. We’re not affiliated with them.

Captson can connect to, or link to, services run by others, such as Instagram, Google, TikTok and YouTube. Their own terms and privacy policies apply to your use of them, and we aren’t responsible for them. You can disconnect a service at any time. Captson isn’t affiliated with, endorsed by or sponsored by any of these platforms, and their names are used only to describe what Captson works with.

9. Plans, payment and cancelling

In plain words: The free plan is free. Paid plans renew until you cancel, and you can cancel any time from your settings.

The free plan needs no payment card. Paid plans are billed in US dollars, monthly or yearly, in advance, and renew automatically until you cancel. Local taxes are added where they apply. We’ll tell you before a yearly plan renews.

You can cancel any time from your settings. Your plan keeps working until the end of the period you’ve paid for, then stops; nothing renews after you cancel. If we change a price, the new price applies from your next renewal, and we’ll tell you at least 30 days before.

Set before launch: Payment provider, refund policy and statutory withdrawal rights for EU and UK customers.

10. Captson’s own material

In plain words: The Captson name, app and site belong to us. Feedback you send us may be used to improve Captson.

Captson, including its software, design, name and logo, belongs to us or our suppliers. These terms give you a personal right to use it while your account is active; they don’t give you any ownership.

If you send us feedback or suggestions, we may use them to improve Captson without owing you anything. Please don’t send anything you consider confidential.

11. Suspending or closing accounts

In plain words: We may suspend accounts that break these terms. You can leave at any time.

We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or to protect other users or Captson. Where reasonable, we’ll tell you first and give you a chance to fix the problem. If we close a paid account without a good reason under these terms, we’ll refund the unused part of your plan.

Sections 4, 5, 6 (the last paragraph), 10, 12, 13 and 15 continue to apply after your account closes.

12. Our responsibility to you

In plain words: We work hard to keep Captson reliable, but it’s provided as it is, and our liability is limited.

Captson is provided “as is” and “as available”. To the extent the law allows, we don’t give any promise that it will be uninterrupted, error-free or suitable for a particular purpose, beyond what these terms say.

To the extent the law allows, we aren’t liable for lost profits, lost revenue, lost data or indirect or consequential losses, and our total liability to you for any claim is limited to the greater of US$50 or the amount you paid us in the six months before the claim.

Nothing in these terms limits liability that can’t be limited by law, or takes away rights you have as a consumer under the laws of your country.

13. If someone makes a claim about your content

In plain words: If your content or your misuse of Captson leads to a claim against us, you cover the reasonable costs.

If you use Captson for business, you agree to cover our reasonable costs, including legal fees, from claims by others arising from your content, your breach of these terms or your breach of the law. We’ll tell you promptly about any such claim.

14. Changes to these terms

In plain words: If we change something important, we’ll email you before it applies.

We may update these terms. For material changes, we’ll email you or show a clear notice in Captson at least 30 days before they take effect. If you don’t agree, you can cancel before then. The date at the top always shows the latest version.

15. Law and disputes

In plain words: If something goes wrong, contact us first. We’ll try to sort it out together.

If you have a problem with Captson, please contact us first; most issues can be fixed quickly.

Set before launch: The company that runs Captson, the governing law, the courts that hear disputes, and any dispute-resolution process. These depend on where Captson is incorporated.

16. General

In plain words: These terms and the Privacy notice are the whole agreement.

These terms, together with the Privacy notice and any plan details shown at checkout, are the whole agreement between you and us about Captson. If part of them can’t be enforced, the rest still applies. If we don’t enforce a part straight away, we haven’t given up the right to. You can’t transfer these terms to someone else without our agreement; we may transfer them to a company that takes over Captson, and we’ll tell you if that happens.

We’ll communicate with you by email or in Captson, and those messages count as written notice.

We aim for the site to meet the Web Content Accessibility Guidelines (WCAG) 2.2, level AA. If anything is hard to use, tell us and we’ll fix it.

17. Contact

In plain words: Questions about these terms? Reply to any email from Captson.

Until launch, reply to any email from Captson and we’ll answer.

Set before launch: Company name, registered address and a contact email address.
